Terms & Conditions

These Terms & Conditions apply to all bookings made with Elan Safaris. By booking a trip, you agree
to abide by the terms outlined below.
1. Booking & Payment Policy
1.1 Booking Confirmation
All bookings are confirmed only after receipt of a non-refundable 50% deposit of the total tour cost. The
balance is payable no later than 45 days before the start of the safari.For Safaris beginning within less than 45 days , Full payment is required .
1.2 Late Payments
Failure to pay the balance by the due date may result in cancellation of your booking, with applicable
cancellation fees.
2. Cancellation Policy
2.1 Client Cancellations
All tours have a non refundable deposit. This is 50% of the total cost .
The following cancellation fees apply:
- More than 60 days before departure , if 100% of total tour cost was paid , the client will receive a refund of 50% of the total cost.
- 15-30 days before departure: 75% of total cost
- 14 days or less before departure: 100% of total cost (no refund)
- Please note that , a credit note will be issued incase cancellation falls under special circumstances for cancellations within 45 days of travel date .
2.2 No-shows or Early Departures
No refunds will be given for no-shows or for unused portions of a trip once it has begun.
2.3 Operator Cancellations
In the rare event that Elan Safaris cancels your trip (for example due to safety concerns or force majeure),
we will offer a full refund or credit towards a future trip, depending on your preference.
3. Amendments & Changes
Changes to the itinerary after booking may be possible but will incur additional charges, depending on
supplier policies and availability. Last-minute changes may not be guaranteed.
4. Health & Medical Requirements
4.1 Health Declaration
All travelers must be in good health to participate in our safaris. You are responsible for informing us of any pre-existing medical conditions, allergies, or mobility issues at the time of booking.
4.2 Vaccinations & Insurance
You are responsible for obtaining the necessary vaccinations and travel insurance, including emergency medical evacuation. We highly recommend comprehensive travel insurance that covers trip cancellation, delays, illness, and baggage loss.
4.3 Fitness for Travel
We reserve the right to decline a booking or remove a participant if their physical or mental condition poses a
risk to themselves or the group. No refunds will be issued in such cases.
5. Travel Documents
It is your responsibility to ensure that you have a valid passport, necessary visas, and any other documentation required for travel. We can offer guidance but are not liable for missed departures due to incorrect or missing documents.
6. Liability & Assumption of Risk
6.1 Limitation of Liability
While we strive to ensure a safe and enjoyable trip, Elan Safaris is not liable for:
- Personal injury, illness, or death.
- Loss or damage to personal property.
- Delays, cancellations, or changes due to weather, acts of God, government actions, or third-party provider
actions
6.2 Acknowledgement of Risk
By booking, you acknowledge that safaris involve risks including travel in remote areas, contact with wildlife, and varying weather conditions. You accept full responsibility for these risks.
7. Third-Party Services
Elan Safaris acts as a tour operator and coordinates services with various independent third-party providers, including but not limited to airlines, hotels, transport companies, and local activity operators. While we take great care in selecting reputable partners, Elan Safaris does not own or operate these third-party services and, therefore, cannot accept liability for any injury, loss, damage, delay, or inconvenience caused by the actions or omissions of these third parties.
Clients acknowledge that participation in activities arranged through third parties is at their own risk and that such activities may be subject to the terms and conditions of the respective service providers, including limitations of liability and insurance requirements.
By booking with Elan Safaris, clients agree that the company shall not be held responsible for any acts of God, force majeure, accidents, personal injuries, illnesses, property loss, delays, or other unforeseen circumstances beyond our direct control.
We will, however, make every reasonable effort to assist in resolving any issues that may arise with third-party service providers and to ensure your safety and satisfaction throughout your safari experience.
8. Photography & Marketing
During your safari, our team or guides may take photos or videos for promotional purposes. If you do not wish
to appear in such content, please inform us before the trip begins.
9. Disputes & Governing Law
These Terms are governed by the laws of Kenya. Any disputes arising from these Terms or your travel with
us will be handled under Kenyan jurisdiction.
